Legal Notice – General Conditions of Use

The purpose of these General Conditions is to regulate the conditions of use of the Website https://toledomonumental.com  (hereinafter, “the website”), whose owner is ARCHBISHOPRIC DE TOLEDO, (hereinafter, ARCHBISHOPRIC), with CIF(Company tax Code) R4500002C, and with address at Calle Arco de Palacio, 3, 45002 – Toledo and which can be contacted via architoledo@architoledo.org  and telephone 925224100.

 

  1. Conditions of access.

The purpose of this website is to provide information on our services and activities. Its use implies full acceptance by the user of these conditions, so if you do not agree with the content of the same, you should refrain from using the web, as well as the services offered on it. ARCHBISHOPRIC reserves the right to make the modifications it deems appropriate, being able to modify, delete or include, without prior notice, new content and/or services, as well as the way in which they are presented and located and the conditions of use of the web.

The User accepts that access to and use of the website and the contents included therein takes place freely and consciously, under his/her exclusive responsibility, and consequently undertakes to:

. – Not to use the website to carry out activities contrary to the law, morality, public order, in general, and to use it lawfully and honestly in accordance with these General Conditions, as well as to refrain from carrying out any act that could damage, disable, overload or deteriorate the website and/or prevent its normal use and utilisation by the rest of the Users.

. – Not to manipulate or alter any content of the website without the express written consent of its owner. Any alteration, modification or manipulation without the consent of the owner shall exempt the latter from any liability whatsoever.

. – Not to reproduce, copy, distribute, communicate publicly, transform or modify the contents, unless you have the authorisation of the owner of the corresponding rights or it is legally permitted; as well as to suppress, avoid or manipulate the Copyright and other data identifying the rights of ARCHBISHOPRIC or its owners incorporated to the contents, as well as the technical protection devices, or any information mechanisms that could contain the aforementioned contents.

. – Not to introduce or disseminate on the website, data programmes (viruses or any type of harmful software) likely to cause damage to the website. 

ARCHBISHOPRIC does not guarantee the availability and continuity of the website and is not responsible for any damages that may occur, or technical defects, including viruses or other harmful elements, whatever the nature, arising from the use of information and materials contained on the web.

The User will be responsible for damages of any nature that ARCHBISHOPRIC or any third party may suffer as a consequence of the non-fulfilment of any of the obligations to which he/she is subjected by the present General Conditions.

ARCHBISHOPRIC does not assume any responsibility nor does it have any control over the possible hyperlinks contained in the web to external contents. Nevertheless, it will remove those links that include illicit contents as soon as it becomes aware of it.

  • Intellectual and Industrial Property

The User acknowledges that all the contents of the website and, specifically, all the information and materials, the structure, selection, arrangement and provision of its contents, programmes and development of applications used in relation to them, are protected by intellectual and industrial property rights owned by the owner of the website or, where appropriate, by third parties.

Under no circumstances shall access to them or their use by the User imply any kind of waiver, transmission or total or partial transfer of such rights, nor confer any right of use, alteration, exploitation, reproduction, distribution or public communication of such content without the prior and express authorisation specifically granted for that purpose by ARCHBISHOPRIC or the third-party holder of the rights affected.

In the case that any User or third party considers that any of the contents have been introduced in the web with violation of their Intellectual or Industrial Property rights, they must send a notification to ARCHBISHOPRIC identifying themselves and the holder of the intellectual or industrial property rights supposedly infringed, providing title or accreditation of the representation of the mentioned rights.

    • Purchasing procedure

To purchase the TOLEDO TOURIST WRISTBAND, it will only be necessary to click on the access button provided for this purpose.

ARCHBISHOPRIC reserves the right to modify the commercial offer presented on the website (regarding products, services, prices, promotions and other conditions) at any time.

ARCHBISHOPRIC will make every effort within its means to offer the information contained on the website truthfully and without typographical errors. In the event that, at any time, there is an error of this type, it will be corrected immediately. If there is a typographical error in any of the information regarding our products, and an ARCHBISHOPRIC has made a purchase decision based on this error, ARCHBISHOPRIC will communicate this error to the ARCHBISHOPRIC, having the ARCHBISHOPRIC the power to cancel the purchase without any cost on their part or adhere to the conditions and / or price again communicated.

  • Prices and payment

The prices indicated on the website include Value Added Tax (VAT) and are expressed in euros.

CHILDREN UNDER 11: FREE ADMISSION

REGISTERED AS RESIDENT IN TOLEDO: FREE ADMISSION (In order to enjoy free admission to our monuments, you must show your ID card at the entrance or a certificate of registration as a resident in Toledo. You can only enter once a day and only during the regular opening hours of each monument).

The products purchased must be paid for by one of the following methods:

  1. Apple Pay.
  2. MasterCard, Visa, Discover and American Express cards
  3. Paypal
  4. Alipay, Wechat… etc.

Visa and MasterCard have developed a secure payment system in an SSL Internet environment. The Secure E-Commerce system is based on the card issuer (bank or savings bank) identifying the cardholder before authorising payment over the Internet.

Your card details and password are protected by this security system from the moment of its introduction. This window is out of the control of ARCHBISHOPRIC, being the responsibility of your Issuer any incidence that may arise with it. You should contact your entity if you find yourself in this hypothetical case.

  • Method and cost of shipment

When you purchase the TOLEDO TOURIST WRISTBAND, you will receive a QR code by email (make sure you enter your email address correctly) which you can exchange for the wristband at any of the seven monuments.

  • Right of withdrawal

Due to the nature of the purchase, the right of withdrawal does not apply. Tickets cannot be exchanged or refunded. If, for any reason, a date has to be changed, the show in question will be moved to another date. The cancellation of the show will be the only admissible cause for the refund of the tickets amounts (Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws).

  • Confidentiality

Any information communicated or made available by either party to the other or to which either party has access shall be considered confidential and may not be disclosed, displayed, reproduced, copied, discussed with third parties, or used by either party for purposes other than those for which it was communicated.

  • Applicable law and jurisdiction

These General Conditions shall be governed by the provisions of Spanish law. For any questions that may arise between the parties in relation to the interpretation and execution of this document, both parties expressly agree, renouncing any other jurisdiction that may correspond to them, to the jurisdiction of the Courts and Tribunals of Toledo.

Online conflict resolution:

In accordance with Art. 14.1 of Regulation (EU) 524/2013, the European Commission has an online out-of-court dispute resolution platform available to consumers. This can be accessed via the following link: http://ec.europa.eu/consumers/odr/ . Consumers can submit their complaints via this platform.
